1Introduction and acceptance

These Terms & Conditions govern your use of the B CARS app and website and the services connected to them. By using the platform or creating an account, you confirm that you have read these Terms and agree to be bound by them.

If you do not agree with any part of them, please stop using the platform.

2Definitions

• "Platform": the B CARS app and website and all their interfaces.
• "Operator" or "we": the entity that operates the platform.
• "User": anyone who browses the platform or creates an account on it.
• "Seller": a user who publishes a listing for a vehicle or a plate number.
• "Buyer": a user who contacts a seller with a view to buying.
• "Showroom": a business account approved on the platform as a showroom or dealer.
• "Listing": a published offer of a vehicle or a plate number.
• "Content": any text, image or data a user uploads.

3Eligibility

To use the platform you must have the legal capacity to contract under the law that applies to you, and you must use it for a lawful purpose.

If you use the platform on behalf of a business, you confirm that you are authorised to do so.

4Accounts

An account is created with an email address and password, confirmed by a code sent to that email. You are responsible for keeping your means of access confidential and for all activity carried out through your account.

The account is associated with the market selected at registration and remains associated with it once registration completes — an account is not moved from one market to another by its holder. B CARS may determine the services and content available to the account based on that market.

You may delete your account at any time from the Account screen.

5Verifying an email, and what the phone number means

Sign-in uses your email address and password. The verification code we email you is personal and must not be shared, and its delivery depends on email providers and may be delayed or fail for reasons outside our control.

We may require your email address to be confirmed before you can publish listings or contact sellers. An email counts as confirmed only when the code we send to it is entered, not according to a statement from you.

A phone number is required on your profile so that buyers can reach you. No verification of that number takes place: B CARS does not attest to it and does not present it as a verified number, and responsibility for its accuracy rests with you alone.

Verifying an email proves access to it at the time of sign-in. It is not verification of the holder’s identity, nor of their right to sell anything.

6User responsibilities

• Provide accurate information and keep it up to date.
• Use the platform in accordance with the laws in force in the Kingdom of Bahrain.
• Do not impersonate anyone or use another person’s account.
• Do not attempt to disrupt, breach or circumvent the platform or its controls.
• Treat other users respectfully in any communication that takes place through or because of the platform.

7What the platform is

B CARS is a digital listings marketplace. It shows vehicle and plate-number listings, offers search, filtering, favourites, notifications and direct contact between buyer and seller, and hosts both individual accounts and approved showroom accounts.

The platform does not provide mechanical inspection, vehicle history reports, financing, ownership-transfer services, or payment handling.

8Our role as an intermediary

Unless the platform expressly identifies itself as the seller in a specific transaction, it is not a party to the sale agreement between users, and is neither seller, buyer, nor agent for either of them.

This intermediary role must not be read as removing mandatory consumer rights, or any responsibility the operator itself may carry under Bahraini law.

9Vehicle listings

A seller publishes a vehicle listing using their own information: make, model, year, mileage, price, description and photographs.

The platform displays what the seller entered. It does not create that information and does not itself verify it.

10Plate-number listings

Plate numbers are shown according to the formats supported in the active market. Whether a number may be transferred, and the procedure and fees for doing so, are governed by the competent authority. The platform neither performs nor guarantees that process.

11Showrooms and dealers

A user may apply to register a showroom. The business details must be accurate, and verification documents such as a commercial registration or trade licence may be requested.

Approval means the application met the information and documents we ask for. It is not a guarantee by the platform of any transaction the showroom concludes, nor of any listing it publishes.

Approval also does not mean that the showroom’s phone numbers have been verified, that its vehicles have been inspected, or that we attest to its financial or legal standing beyond what we actually reviewed. Before a decision is issued, an applicant is not presented as a verified showroom and receives none of the showroom privileges.

A showroom is responsible for its own listings and representations, and we may suspend or withdraw showroom status for breaches.

12Seller representations

By publishing a listing you confirm that the information is accurate and not misleading, that you have the legal right to offer the vehicle or number for sale, and that the images are yours or that you have the right to use them.

13Accuracy of listing information

The seller is responsible for the accuracy of everything presented, including price, mileage, year, condition and specification, and must correct any detail found to be wrong.

14Ownership and the right to sell

You must not publish a listing for a vehicle or number that you have no right to dispose of, or no authority to sell.

15Images and content

Images must show what is actually being offered. Uploading images belonging to someone else without permission, or images carrying another party’s marks or contact details, is not allowed.

16Price

The price is shown in the currency of the active market, as entered by the seller. Government or administrative fees relating to the sale or transfer are not part of that price unless the listing expressly says otherwise.

17Buyer responsibility and inspection

Verification before payment is your responsibility. We recommend that you confirm the following yourself, or through a competent specialist, before completing any transaction:

• The seller’s identity and capacity.
• Ownership and registration details.
• The chassis (VIN) number and that it matches.
• Vehicle history and accident record.
• Mechanical condition, through a technical inspection.
• That the mileage reading is genuine.
• Any finance, lien, seizure or government restriction.
• Whether the plate number may be transferred, and the fees involved.

18Vehicle condition

The platform does not view, inspect or test vehicles, and does not guarantee their technical or mechanical condition.

19Transactions between users

Negotiation, agreement, payment and handover of a vehicle or number take place between users outside the platform and on whatever terms they agree.

We recommend documenting what is agreed and completing the formalities with the competent official authorities.

20We are not a party to the sale contract

Unless the platform is expressly identified as the seller in a specific transaction, it is not a party to the contract concluded between users and does not carry its obligations.

21Review and moderation

Listings may be reviewed before or after publication, using automated and human review.

Every car listing is reviewed by our staff before it is published, and plate listings are reviewed by staff unless automatic publishing is switched on for listings that pass every automated check. We do not undertake that review will detect every breach.

22Approval, rejection and requested changes

A listing may be approved, rejected, or returned for changes before publication. The decision is based on these Terms and on the published listing rules.

23Removing and suspending listings

We may hide, suspend or remove any listing that breaches these Terms or the law, or where a report warrants examination.

Review or removal does not transfer responsibility for a listing’s accuracy away from the seller.

24Account suspension and deletion

We may suspend, restrict or close an account for serious or repeated breaches, or where there are indications of fraud or unlawful use.

You may delete your account at any time. Deletion removes your listings and data as described in the Privacy Policy, subject to anything the law requires us to retain.

25Fraud and prohibited conduct

• Providing false or misleading information.
• Listing a vehicle or number that is stolen, seized, or unlawful to offer.
• Requesting advance payment by deception or on an untrue pretext.
• Manipulating platform systems, result ordering or counters.
• Scraping user data or harvesting phone numbers automatically.
• Misusing displayed contact details for anything other than negotiating the listing.

26Prohibited content

• Content contrary to law or public decency.
• Abusive, discriminatory or inciting content.
• Third-party personal data published without consent.
• Content unrelated to what is being offered, or adverts for other services.

27Duplicate and misleading listings

Publishing duplicate listings for the same item is not allowed, nor are listings with a token price or details that draw a buyer towards something different.

28Unlawful vehicles and numbers

Offering a stolen, forged, disputed or seized vehicle or number is strictly prohibited. We may cooperate with the competent authorities in such matters as required by law.

29Intellectual property

The platform, its design, logo and software belong to the operator and are protected by law. They may not be copied or exploited without written permission.

30Licence you grant us

By publishing listing content you grant the platform a non-exclusive, royalty-free licence to display, host, store and technically resize that content, for the purpose of operating the platform and displaying and promoting your listing within it.

The content remains yours. The practical effect of this licence ends when the listing or account is removed, subject to backups, technical logs, and any retention period the law requires.

31Trademarks

Make and model names and their logos belong to their owners and are used within the platform for identification and categorisation only. No affiliation, sponsorship or endorsement is implied.

32Featured listings

The platform may offer placement of a listing in more prominent positions. Such placement affects where a listing appears only. It is not a recommendation of what is offered, nor verification of its details.

33Showroom subscriptions and paid services

Subscriptions or paid services may be made available to showrooms. Each is subject to the commercial terms displayed at the point of purchase or activation.

34Fees

Fees, subscription charges, featured-listing charges and any applicable taxes are shown to the user before purchase or activation.

Publishing an ordinary listing is free of charge unless the platform states otherwise.

35Cancellation and refunds

Cancellation and refunds are governed by the commercial terms shown when the service is purchased, and by the consumer rights set out in the Bahraini Consumer Protection Law.

36Consumer rights

Nothing in these Terms reduces any right granted to a consumer under the Bahraini Consumer Protection Law (Law No. 35 of 2012) or any other mandatory provision.

Any clause here that conflicts with a mandatory provision is to be read so far as possible in a way that complies with it, or otherwise treated as ineffective only to the extent of that conflict.

37Contact between buyer and seller

A listing provides a direct means of contacting the seller. Offers and agreements made in that contact are between the two of them.

38Contact details

By publishing a listing you accept that a means of contacting you is shown to interested buyers through the contact buttons on your listing. Those details must not be used for anything other than negotiating the listing.

39Reporting a listing or user

You can report any listing or conduct that breaches these Terms from within the platform. We consider reports and take what action we think appropriate, without undertaking to disclose the details of that action to the reporter.

40Privacy and personal data

Your personal data is processed in accordance with the Bahraini Personal Data Protection Law (Law No. 30 of 2018) and with the platform’s Privacy Policy.

41Privacy Policy

The Privacy Policy is a separate document available inside the app. It explains what data we collect, why, how long we keep it, and your rights in relation to it.

42Notifications

We may send you operational notifications about your account, your listings and their review status. These notifications are part of the service.

43Marketing messages

If we send you marketing messages, you will have a clear way to stop them. Stopping them does not prevent operational notifications that your account needs.

44Third-party services

The platform relies on a small set of technical providers: a VPS provider for our servers ([VPS provider, country]), Cloudflare for DNS, HTTPS and protection, Amazon Web Services S3 ([AWS region]) for photos and documents, and [email provider] for email delivery. They act on our instructions and within the limits described in the Privacy Policy.

45External links

A link to an external site may appear within the platform. We do not control the content of those sites and are not responsible for it.

46Service availability

We aim to keep the platform available and do not undertake that it will run without interruption. It may pause temporarily for maintenance, updates or technical reasons.

47Security

We take reasonable technical and organisational measures to protect the platform and its data. You are responsible for protecting your device and your means of access, and for telling us as soon as you suspect unauthorised use of your account.

48Inspection and history disclaimer

The platform does not provide technical inspection, vehicle history reports, or verification of mileage readings or accident records. Anything of that kind in a listing comes from the seller.

49Limitation of liability

To the extent permitted by law, we are not responsible for matters outside our direct control, including: the accuracy of what users enter, the technical condition of vehicles, negotiation, payment and handover between users, transfer procedures handled by external authorities, and the conduct of third parties.

50What cannot be excluded

Nothing in these Terms is intended to exclude or limit any liability that Bahraini law does not permit to be excluded or limited, including liability for fraud or gross negligence, and mandatory consumer rights.

Where exclusion is not permitted, liability remains to the extent the law provides.

51Indemnity

You agree to indemnify the operator for reasonable loss and cost it suffers as a result of your breach of these Terms or of the law, or as a result of content you published.

This does not extend to anything arising from the operator’s own fault or falling within its own responsibility.

52Force majeure

Neither party is liable for a failure caused by an event beyond its reasonable control, such as a communications outage, a disaster or a government decision, for as long as that cause continues.

53Changes to the platform

We may develop the platform, add to it, or discontinue some of its features. Where a change is material and affects an existing paid service, we will tell you.

54Changes to these Terms

We may amend these Terms. The last-updated date appears at the top of this page. Continuing to use the platform after an amendment takes effect means you accept it.

Where an amendment is material we will seek to draw attention to it within the app.

55Termination

You may end your use by deleting your account. We may end or restrict the service for breaches as set out above. Provisions that by their nature should survive termination continue to apply, such as intellectual property, limitation of liability and governing law.

56Severability

If any clause of these Terms is found invalid or unenforceable, the remaining clauses continue to apply, and the clause concerned is read so far as possible in a way that makes it valid.

57No waiver

A delay in exercising a right, or a failure to exercise it, is not a waiver of that right.

58Entire agreement

These Terms, together with the Privacy Policy and any commercial terms displayed when a service is purchased, form the agreement between you and the operator regarding use of the platform, without prejudice to any right the law provides.

59Assignment

You may not assign your rights under these Terms without our written consent. We may assign them in the case of a merger or a transfer of the business, in a way that does not reduce your rights.

60Governing law

These Terms are governed by the laws of the Kingdom of Bahrain, including, where relevant, the Consumer Protection Law No. 35 of 2012, the Personal Data Protection Law No. 30 of 2018, Legislative Decree No. 54 of 2018 promulgating the Electronic Communications and Transactions Law, and the applicable civil and commercial law and the laws on cybercrime and fraud.

61Jurisdiction

The courts of the Kingdom of Bahrain have jurisdiction over any dispute arising from these Terms or from use of the platform, without prejudice to any jurisdiction conferred by mandatory consumer-protection provisions.

62Complaints and contact

You may contact us about any complaint or legal question through the contact channels published in the app. We aim to respond within a reasonable time.

63Language

These Terms are issued in Arabic and English. If there is an inconsistency between the two versions, the Arabic version prevails to the extent permitted by applicable law.

64Effective date

These Terms take effect from the last-updated date shown at the top of this page.
